Terms of Service

These terms govern your use of ToneVault (https://tonevault.zadenconnell.com). By creating an account or using the service you agree to them. If you do not agree, do not use the service.

Eligibility

You must be at least 13 years old (or 16 in jurisdictions where that is the digital-consent age) to use ToneVault. By signing up you confirm you meet that threshold.

Your account

• You are responsible for activity on your account. Keep your password secret and consider enabling TOTP two-factor authentication at Settings → Security.
• You may have at most one personal account. Do not impersonate other people or organizations.
• We may suspend or remove accounts that violate these terms or the acceptable-use policy below.

Your content

You retain ownership of the content you create or upload — your patches, tones, rigs, collections, audio, images, and text. By posting content you grant [Operator name to be set] a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute that content solely to operate, develop, and provide ToneVault to you and (for content you make public or share with a group) to the audience you choose.

This license ends when you remove the content, except (a) for forks others have already made — which carry their own snapshot and are not removed when the original is deleted, and (b) for backups and logs that take a reasonable time to expire.

Preset files and attribution

ToneVault accepts preset files for digital modelers (Helix, Strymon, Fractal, and similar formats) and makes them downloadable on public Patch pages. By uploading a preset file you confirm one of the following:

• You authored the preset yourself; or
• You have a license to redistribute it; or
• It is publicly distributed by the manufacturer or original author.

Where the upload form offers an attestation, please select the applicable option. We honor copyright takedowns via the DMCA process. Repeated infringement leads to account termination.

Acceptable use

Do not use ToneVault to:

• Post content that infringes copyright, trademark, or other rights.
• Post illegal, harassing, hateful, sexually explicit, or violent content, or content that targets minors.
• Distribute malware, run automated scraping that ignores rate limits, or attempt to break authentication or visibility controls.
• Impersonate other people, spam other users, or evade bans.
• Use the service for paid services, lessons, or commercial listings without our prior written consent.

You can report content that violates these rules with the “Report” button on any public item, or by emailing abuse@example.com.

Service availability

ToneVault is provided on a best-effort basis. We may change, suspend, or discontinue features at any time. Free-tier limits (storage, uploads per day, email volume) are enforced and may be adjusted. We will give reasonable notice on the changelog for material changes.

Termination

You can deactivate or permanently delete your account at any time from Settings → Security. Deactivation hides your content for 30 days; you can recover by signing back in. Permanent deletion removes your account and soft-deletes your content (see the Privacy Policy for retention details).

We may suspend or terminate accounts that violate these terms, with notice where reasonable and immediately for severe violations (illegal content, repeat infringement, abuse).

Disclaimers

TONEVAULTIS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. PARSED PRESET DATA IS A BEST-EFFORT INTERPRETATION OF FILES YOU UPLOAD AND MAY DIFFER FROM THE BEHAVIOR IN THE VENDOR’S OWN SOFTWARE.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, [Operator name to be set] WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUES, OR DATA, ARISING FROM YOUR USE OF TONEVAULT. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM RELATED TO THE SERVICE IS LIMITED TO USD 100.

Indemnity

You agree to indemnify and hold [Operator name to be set]harmless from claims arising out of (a) content you upload or share, (b) your violation of these terms, or (c) your violation of any third party’s rights.

Governing law

These terms are governed by the laws of [Governing jurisdiction to be set], without regard to conflict-of-laws principles. Disputes will be resolved in the courts of [Governing jurisdiction to be set].

Changes

We may update these terms. Material changes will be announced on the changelog. Continuing to use ToneVault after a change means you accept the new terms.
